Thank you for reading and your question!

You're right, the focus here was on the higher judiciary. In the lower judiciary, judges are recruited through competitive exams, and there is a reservation for SCs, STs, OBCs and sometimes women, differing across states. In the district judiciary, women constitute approximately 36.3% of judges, according to the Supreme Court's State of the Judiciary report 2023. This indicates a relatively better representation at the entry-level.

However, the glass ceiling effect still shows up. As we move up the hierarchy, the numbers decline significantly. Currently, women comprise only 13.4% of High Court judges and 9.3% of Supreme Court judges. This drop shows the 'leaky pipeline' problem I was referring to.

Even though more women and marginalized groups enter through the exam system, many drop out along the way due to systemic barriers (fewer promotions, biases, lack of support, to name a few). So, by the time people reach the higher courts, the representation is already thinned out.
